Luum Customer Agreement

Section 1: Payment Terms

• A non-refundable deposit is required in order to receive your LUUM kit. 

• Approved designs will not go into production until payment is made in full.

• Payments for all approved designs are non-refundable.

• Prices for approved designs include standard shipping.

• Estimated Lead times exclude holiday closure. 

 

Section 2: Design and Quality Assurance

• Due to the custom nature of our work, each piece is different. LUUM cannot assume responsibility for natural variations in materials, including but not limited to color and finish. 

• As required LUUM is authorized to use standard master alloys or precious metal supplements  in casting your ring. 

• LUUM cannot definitively determine the full contents of any customer-supplied jewelry

• LUUM will use industry best practices when necessary to attempt to verify the karat of customer-provided jewelry if it is not clearly marked or third party verified. 

• LUUM cannot assume responsibility for any minor damage in the process of karat-testing customer-provided jewelry. 

• LUUM reserves the right to reject customer-provided jewelry if they deem it unfit for use.

•  In the case that customer-provided jewelry is deemed unfit, the customer may request the return of their jewelry and will be responsible for any shipping and handling costs related to the return

• LUUM is not responsible for the final purity of a ring made using customer-provided Jewelry. 

• LUUM is not  responsible for any allergies or irritation resulting from the reuse of customer-provided jewelry.    

• When LUUM uses Customer-provided jewelry to craft a ring, they are not responsible for variations in the final color or texture of the ring or for discoloration over time.

 

Section 3. Process and Client-Vendor Relationship Clarifications / Client Requirements

• LUUM does not encourage or condone removal of dirt, sand or other material from national parks, state beaches or other protected lands or locations for use as a customer’s casting medium. . 

• All noble metal shipments are insured. LUUM is not liable for lost shipments and is not liable for the recovery of customer provided noble metals lost by third party shippers, but will guarantee the delivery of a LUUM band or recasting of a band per contract in the rare case that a shipment is lost.  

• Customer authorizes LUUM to donate the value of excess customer-provided jewelry to a charity of their choosing and understands that this donation is made in the name of the company and not the customer for the purposes of a tax write-off. 

 

Section 4: Warranty Terms and Conditions

• Each LUUM band comes with a One (1) Year Limited Warranty 

  • LUUM provides a limited one-year warranty covering defects in material and workmanship. The warranty applies to the  original consumer purchaser of our jewelry from the date of original purchase. 

  • The warranty is not transferable. 

  • This warranty applies under conditions of normal use but expressly excludes:  

    • Natural variations in materials due to the custom nature of the product, 

    • Normal wear and tear, 

    • Cuts and scratches,  

    • Defects that result from negligence, soiling, improper cleaning, improper storing, abuse, misuse, abnormal use, accident, or commercial use, and 

    • Costs for packing and shipping your product back to LUUM for warranty evaluation. 

  • Warranty Service

    • To obtain service under the terms of this warranty, contact LUUM customer service via the contact form on our website or via email at info@LUUMjewelry.com, . When you submit a claim for service, you must provide the original  purchase receipt as proof of purchase. 

    • LUUM will, in its sole discretion, decide whether to repair, replace, or provide a substitute for any piece or part that LUUM finds, in its sole discretion, to be defective in material or workmanship.

  • Disclaimer of Express Warranties, Implied Warranties, and Incidental or Consequential Damages 

    • To the extent permitted by law, this warranty is exclusive and in lieu of any other warranty,  written or oral, including but not limited to any express warranty of merchantability or  fitness for a particular purpose. The duration of any implied warranties, including any implied  warranty of merchantability or fitness for a particular purpose, is expressly limited to this  warranty period. Your exclusive remedy for breach of this warranty or of any implied  warranty or of any other obligation arising by operation of law or otherwise shall be limited as specified herein to repair or replacement, at our sole option. responsibility for incidental or consequential damages is expressly excluded. 

      This warranty gives you specific legal rights, and you may have other rights that vary from state to state. Some states do not  allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. Some states do not allow  the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. 

    • LUUM reserves the right to amend these warranty provisions.
